Terms of Service

Please read these Terms of Service (the Terms) carefully before using the Penzum service. By registering and using the Service, you accept these Terms.

The Provider operates the Penzum digital service as a sole proprietor. The Provider is not subject to any chamber or regulatory registration in connection with Penzum — providing a SaaS software service is an activity that may be carried out under a sole-proprietorship structure in Hungary.

2. Scope and Acceptance of these Terms

These Terms apply to the use of the Penzum web application (penzum.app). They apply to every natural person who uses the Penzum service (the User).

During registration, the User explicitly accepts these Terms and the Privacy Policy by checking the relevant checkbox. The time of acceptance and the version identifier accepted are logged by the system.

These Terms are available in Hungarian, English and German via the language switcher in the top-right corner. In case of any discrepancy or interpretation dispute, the Hungarian-language text prevails.

3. Definitions

  • Provider: Simon Richárd e.v. (Hungarian sole proprietorship), a sole proprietor.
  • User: Any natural person who creates a Penzum user account.
  • Service: The digital financial-management tool provided by the Penzum web application.
  • Account: The set of data stored in the Provider’s systems containing the User’s unique access rights.
  • Subscription: The recurring, paid service-access entitlement purchased by the User — Penzum offers a single subscription plan, identical in content for every user.
  • Trial period: A 30-calendar-day, free-of-charge period during which the User may try every feature of the Service without limitation.
  • Sole proprietor (EV): The target audience of the Service — an individual entrepreneur under Hungarian law.

4. Description of the Service

Penzum is a web-based financial management application developed exclusively for Hungarian sole proprietors (EVs). The Service is designed to help sole proprietors track their income, expenses and tax obligations.

4.1 Features of the Service

The subscription is a single plan, identical for every user — there are no differing feature tiers. The subscription includes:

  • Dashboard — summary of income, expenses, taxes and available cash
  • Online invoicing sync (Billingo and other systems via API connection)
  • Expense tracking by category, with receipt photo attachment
  • Tax-obligation calendar — quarterly tax advance, social-security, and small-business tax deadlines
  • VAT-exemption threshold monitor with early warning
  • Actual and scenario tax calculators — full tax breakdown based on real year-to-date income, plus “what if” planning
  • Life-event log — recording a change of sole-proprietor type, birth/adoption of a child
  • Primary-employment data for part-time sole proprietors — recording employer income and allowances used
  • Automated data sync, notifications, and an AI-based advisor

4.2 Limitations of the Service

Penzum is an informational tool. The taxes, contributions and obligations presented by the Service do not constitute tax, accounting or legal advice. The User is responsible for filing their tax returns and making payments in compliance with applicable law. For precise tax questions, please consult an accountant or tax expert.

5. Registration and Account Management

5.1 Registration

Registration is required to use the Service. Registration requires a valid e-mail address and password, and acceptance of these Terms and the Privacy Policy. Registration must be activated via e-mail confirmation.

A User may only register on their own behalf. One account may be created per e-mail address. The User is responsible for keeping their account credentials (in particular, their password) confidential.

5.2 Account Deletion

The User may delete their account at any time, without justification, on the Settings page. Upon account deletion, all personal and financial data is permanently deleted from the system. If a subscription is active, deletion is also treated as a cancellation; no refund is due for the period already paid for (see section 8).

6. Starting a Subscription

After registration, the User selects a billing cycle:

  • Monthly cycle: a 30-calendar-day free trial period begins, requiring card details to be provided. During the trial, every feature of the Service is available free of charge. The first charge is due when the trial ends, unless the User cancels during the trial.
  • Annual cycle: the subscription fee is due immediately upon selection, with no trial period; the annual fee equals ten times the monthly fee (a two-month discount).

7. Subscription Fees and Payment Terms

Prices are gross prices (including VAT, where applicable). The Provider reserves the right to change prices; Users are notified of any price increase by e-mail at least 30 days in advance.

7.2 Payment

Payment is processed by Stripe Ireland Limited (payment provider) via credit or debit card. Card data is stored exclusively by Stripe — the Provider never sees or stores it. The subscription automatically renews each month on the day corresponding to the activation date.

7.3 Failed Payment

In the event of a failed payment, Stripe automatically attempts to retry the charge. If retry attempts also fail, the User receives an e-mail notification and the Service may be restricted.

8. Cancellation and Refunds

8.1 Cancellation by the User

The User may cancel their subscription at any time, with immediate effect, on the Settings → Subscription page (Stripe Customer Portal). After cancellation, the User retains access to the Service until the end of the current billing period; no further charge is applied.

8.2 Refund Policy

Subscription fees are non-refundable, except where the Provider has failed to make the Service available for more than 72 continuous hours in a given month (outside of planned maintenance downtime). In that case, the Provider will credit or refund a proportional part of the fee for the affected month.

The EU 14-day right of withdrawal for digital content is waived upon the consumer’s explicit consent and the provision of immediate access. By registering and making use of immediate access, the User acknowledges that the right of withdrawal does not apply.

8.3 Cancellation by the Provider

The Provider is entitled to terminate a User’s account with immediate effect if the User seriously breaches these Terms (in particular: abuse, unauthorised access, or interference with other users). In such cases, the subscription fee will not be refunded.

9. User Obligations

The User undertakes to:

  • provide true and accurate information at registration and while using the Service;
  • not share their account login credentials with any third party;
  • use the Service only for lawful purposes and in compliance with applicable law;
  • not attempt to bypass the system’s security, overload the Provider’s infrastructure, or access other users’ data;
  • not upload viruses, malicious code, or unlawful content;
  • notify the Provider immediately upon detecting misuse of their account.

10. Provider Obligations and Limitation of Liability

10.1 Availability

The Provider strives for continuous availability of the Service but does not guarantee 100% uptime. Users are notified in advance of planned maintenance. The annual target availability is 99.5%.

10.2 Data Backup

The Provider performs daily backups of User data. In the event of data loss, the Provider will attempt to restore data from the most recent backup, but accepts no liability for damages resulting from data loss.

10.3 Limitation of Liability

The Service is provided on an “as-is” basis. The Provider is not liable for:

  • incorrect calculations resulting from erroneous data entered by the User;
  • discrepancies arising from actions of the tax authority, an accountant, or changes in legislation;
  • fines or interest resulting from a tax return missed or a payment delayed by the User;
  • damages resulting from failures of third-party systems (Billingo, Stripe, Supabase);
  • downtime resulting from force majeure events.

The Provider’s liability is in every case limited to the amount of subscription fees actually paid by the User for the month in question.

11. Intellectual Property

The Penzum web application — including its source code, design, text, logo, and the Service as a whole — is the intellectual property of the Provider. The User is granted a non-exclusive, non-transferable, personal right of use for the duration of the subscription.

The User retains full ownership of the data they themselves enter (invoices, expenses, etc.). The Provider processes this data solely for the purpose of providing the Service and is not entitled to sell it to third parties.

12. Data Processing

The Provider processes the User’s personal data while the Service is used. Detailed rules on data processing are set out in the Privacy Policy, which forms an integral part of these Terms.

13. Changes to these Terms

The Provider is entitled to unilaterally amend these Terms. Users are notified by e-mail at least 15 days before the amendment takes effect, together with a summary of the changes.

If the User does not accept the amendment, they are entitled to cancel the Service. Continued use of the Service after the amendment takes effect constitutes acceptance of the new Terms.

14. Complaints and Disputes

For complaints, please contact us by e-mail: support@penzum.app. The Provider responds to complaints within 15 business days.

In the event of a consumer dispute, the User is entitled to contact the Conciliation Board (Békéltető Testület) competent for their place of residence. The EU Online Dispute Resolution platform (ODR) is available at: ec.europa.eu/consumers/odr.

These Terms are governed by Hungarian law. The parties will primarily attempt to resolve disputes through negotiation. Failing that, the parties accept the jurisdiction of the court competent for the Provider’s registered address.

15. Miscellaneous

  • Notices: The Provider notifies Users by message sent to their registered e-mail address. The User is responsible for ensuring that the e-mail address provided remains active and accessible.
  • Severability: If any provision of these Terms becomes invalid, this does not affect the validity of the remaining provisions.
  • Limitation period: The User’s claims against the Provider are subject to the general civil-law limitation period.
